macushlaw Lead Counsel on Redwood Meadows Lease Extension
We are pleased to announce that the Townsite of Redwood Meadows, a 351 home community southwest of Calgary located within Tsuut’ina Nation’s Reserve 145, successfully obtained a sublease interest and extended residents’ leasehold interests by an additional 50 years. The community was initially developed in the 1970s, with 75-year prepaid leases expiring in 2049.
The extension and renewed governance structure have strengthened an already long-standing, strong community bond between Townsite’s council and residents and Tsuut’ina Nation’s government and citizens, strengthened the Townsite’s ability to govern the Redwood Meadows community through Tsuut’ina Nation’s authority, increased lease values, and modernized the lease documents.
macushlaw advised the Townsite on the extension project, drafted key project documents, negotiated key deal terms with key parties and stakeholders, and led execution and registration of the extended resident leaseholds and related documents. We are grateful to have worked with the Townsite’s tireless volunteer council, Tsuut’ina Nation’s experienced and temperate legal team and leadership, Indigenous Services Canada’s dedicated registry staff, the First Nations Tax Commission, the Department of Justice and various institutional lenders in closing this extension project.
